Xaac Terms of Service

Xaac provides intelligent document management and organization capabilities for business and personal use, designed to help users organize, analyze, and structure their digital documents efficiently. Core features of the Service include:

• Automatic identification of document types (tax documents, bank statements, invoices)
• Smart document renaming for improved clarity
• Intelligent splitting of multi-form PDF documents

3. User Responsibilities

3.1 Account Registration

You must create an account through our platform. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Xaac is not liable for any loss or damage arising from unauthorized use of your credentials.

3.2 Compliance with Laws

You agree to use the Service in compliance with all applicable laws, regulations, and industry standards.

3.3 Uploaded Content

You represent and warrant that:

• You have the right to upload any policy documents or other materials (“Content”) to the Service.
• Your Content does not infringe on the intellectual property rights of any third party.

You retain ownership of your Content. By uploading Content, you grant Xaac a non-exclusive, worldwide, royalty-free license to store, process, and index your Content solely for the purpose of operating, maintaining, and improving the Service. This license terminates automatically when you delete your Content or close your account, except where retention is required by law or for legitimate business purposes (e.g., backups, auditing).

4. Data Handling and Privacy

4.1 Data Storage and Processing

Content uploaded to the Service is securely stored and indexed in databases managed by LlamaIndex. We use artificial intelligence technology to process documents for metadata extraction.

4.2 Data Security

Xaac employs reasonable measures to protect your data, but we cannot guarantee absolute security. By using the Service, you acknowledge and accept the inherent risks of transmitting data over the internet.

4.3 Privacy Policy

Our collection, use, and storage of personal data are governed by our Privacy Policy, which is incorporated into these Terms by reference.

5. Fees and Payment

5.1 Subscription Fees

You are responsible for all fees associated with your use of the Service. Failure to pay may result in suspension or termination of your account.

You acknowledge that outputs generated by Xaac's AI systems may contain errors or inaccuracies and should not be solely relied upon for compliance, legal, or financial purposes.

7. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for violation of these Terms or other reasons.

8. Intellectual Property

Xaac retains all rights, title, and interest in the Service, including software, interfaces, and underlying technologies. You are granted a limited, non-exclusive license to use the Service as outlined in these Terms.

9. Limitation of Liability

To the maximum extent permitted by law, Xaac, its affiliates, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Service, whether based on contract, tort, negligence, strict liability, or otherwise, even if Xaac has been advised of the possibility of such damages. In no event shall Xaac’s total liability exceed the amount paid by you (if any) for access to the Service during the twelve (12) months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law principles.

11. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in Maricopa County, Arizona, under the rules of the American Arbitration Association. Each party shall bear its own costs, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction. You agree that you may bring claims against Xaac only in your individual capacity and not as a plaintiff or class member in any class or representative proceeding.

12. Changes to the Terms

We may update these Terms from time to time. Changes will be effective upon posting to our website. Continued use of the Service constitutes your acceptance of the revised Terms.
